LIPKAN Volodymyr Anatoliyovych was born in Kyiv, Ukraine. Education: higher education in law, economics, security.

LIPKAN Volodymyr Anatoliyovych is a Doctor of Laws, Associate Professor, defended candidate thesis on the issues of terrorism and doctoral thesis on the problems of national security, an Vice-President advisor of Academy of Open Society Security, an expert of Expert Council of “International Anti-Terrorist Unity” social organization, a member of Expert Commission at the Board of Ukrainian Union of Industrialists and Entrepreneurs on corporative security, professor of Institute of Security Management.

The following issues were studied in the candidate research: The dissertation is a complex scientific and practical analysis of national security as an object of defense from terrorism. The doctrinal notion of terrorism was studied as well as its correlation with other social and political and social and legal notions. The criminal and legal assessment of terrorism was given, the forms of its display were revealed. Special emphasis was laid on consideration of the problems of ensuring national security by the bodies of internal affairs of Ukraine. A number of suggestions were made as for the improvement of legislation to prevent terrorism as well as the improvement of the activity of internal bodies to defend Ukraine’s national security from terrorism. It was for the first time that two notions of struggle against terrorism were outlined: antiterrorism — the actions of the authorized state governmental bodies to prevent and reveal terrorist crimes, to reduce the vulnerability of individuals and property from terrorist acts, to neutralize post-terrorist situations and counter-terrorismthe actions of the authorized state power bodies as for the preventive liquidation of the subjects of the terrorist activity and their infrastructure. Opposite to anti-terrorism which is marked by reactive character, i.e. begins at the moment of the existing possibility to perform a terrorist act, counter-terrorism is of proactive character that enables to nip the terrorist activity in the bud.

The results of the candidate research are as follows.

  1. For the first time at the level of a dissertational research not only the essence of terrorism but its peculiar properties were revealed that enabled to draw a line  between terrorism and its closely related notions such as aggression, annexing, genocide, racism, fascism, war, repression etc.
  2. The general legal definition was given grounded on the organic unity of peculiar for terrorism features.
  3. The conception, which generalizes the existing classification of terrorism and develops them in accordance with the up today realities, was developed.
  4. For the first time at the level of a dissertational research terrorism is considered as a factor of threat for Ukraine’s national security.
  5. Taking into consideration the danger of terrorism, the major threats for the most important spheres of state and society activity were outlined.
  6. Due to the threats for the state interests revealed the basic trends of state policy in the struggle against terrorism, internal bodies in particular, are outlined.
  7. The author suggests introducing the criminal and legal norm into Criminal Code of Ukraine which could envisage the responsibility for committing a terrorist act. The measures were suggested to improve the interaction of the bodies waging the struggle against terrorism.
  8. The question as for the formation of independent cyberspace of Ukraine as a guarantee of informational security which is a part of the system of national security of Ukraine was discussed.
  9. The study of geopolitical situation in the world made possible to outline the threats of terrorism in the political sphere that exist for Ukraine and to elaborate the ways of their overcoming.
  10. For the first time at the level of a dissertational research such a category of individuals as those who sympathizes and constitute the basis of terrorist groups and organization was considered.
  11. The two major trends of the struggle against terrorism: anti-terrorism and counter-terrorism were formulated and the appropriate tasks were outlined.

In my doctoral dissertation the following problems are studied: The author proves the necessity of formation of the general theory of national security, reveals the essence and the content of the above-mentioned category. The dissertation contains determination of theoretical problems of formation of the mentioned theory and the ways of their solution: the author defines the object, the subject-matter, structure, aims, tasks and functions of the theory. The researcher determines methodological toolkit and gives the proof for the necessity to use the administrative law approach. From the view of administrative law the author shows the significance of threats for the system of national security, the reasons for establishing the system of national security. Besides, he determines the potentialities of synergetic in organization of control of national security threats. The problems of optimization of formation and functioning of the national security system are described in the dissertation.

The author defines the notion and the content of national interests in the age of globalization, determines the problems of formation of the system of national security as well as the problem sphere of national security. The researcher outlines the typological model of threats for national security. The research work is conducted on the ways of improvement of legal provision of the system of national security management. Among the advantages of the work is the determination of shortcomings of legislation on national security and formulation of propositions on its improvement.

In 1993 finished specialized in Physics and Mathematics secondary school № 173 in Kyiv with gold medal.

In 1993 having successfully passed the entrance exams was enrolled as a day time cadet of the Ukrainian Academy of Internal Affairs.

In 1997 was awarded with Volodymyr Sumin prize of the Ukrainian Legal Foundation as a winner of All-Ukrainian Contest of Student Scientific Works.

In 1997 graduated from National Academy of Internal Affairs with distinction.

In 1997 having successfully passed the entrance exams was enrolled as a day time advanced student of the Academy.

In 1999 — due to the outstanding academic achievements was in the group of excellent students on the internship with the German police (Bavaria).

June 21, 2000 completed post-graduate studies ahead of time, defending candidate thesis in National Academy Of State Security of Ukraine: “The defense of national security of Ukraine from terrorism by internal bodies”.

September 30 2002 was awarded with the breastplate-medal “10 Years of Ministry of Internal Affairs of Ukraine”.

In July 2002 taking into consideration professional and business qualities, conscientious attitude to official duties, participation in social and scientific life of the Academy in accordance with the resolution of Cabinet of Ministers of Ukraine of June 13, 2000 No 591 “On  Reward of Cabinet of Ministers of Ukraine” was nominated for the Cabinet of Ministers of Ukraine Reward. In 2002 was awarded with honorary diploma for the significant contribution to the realization of the state youth policy, fruitful work in supporting the social formation of youth development in Ukraine and on the occasion of Youth Day by the State Committee of Ukraine in Family and Youth Affairs.

In February 2003 successfully graduated from the European University of Finance, Informational Systems, Management and Business being qualified as a specialist in management of organizations.

In April 2003 took part in getting the grant of President of Ukraine for gifted young people.

From May 23 till July 19 2003 was trained in International Law Enforcing Academy in Budapest, Hungary. During the studies performed the duties of the head of the Ukrainian delegation. For the considerable achievements in studies and active organizational activity was recognized as the top student of the Ukrainian delegation (among 13 students) and the top student of Session 41 (among 47 members representing Ukraine, Hungary, Russia and Romania) which resulted in awarding with a commemorative medal and appropriate diploma by the chief of criminal police of Hungary. During the studies implemented the results of the doctoral research which is certified with the appropriate document.

In February 2003 successfully graduated from International Law Enforcement Academy of US State Department in Rosewell, NM, USA.

In March 2010 successfully graduated from the Educational and Scientific Institute of Security Management, University of Economics and Law “KROK”, Kyiv, Ukraine being qualified as a Professional in Financial and Economic Security Management.

In February 2011 successfully graduated from UNIVERSITY OF DELAWARE,

Lipkan Volodymyr Anatoliyovych is one of the founders of the national security theory. He has elaborated theoretical and methodological foundations of ensuring national security of Ukraine. This enables to formulate on their basis the proposals of theoretical, methodological and organizational and legal significance, scientifically grounded recommendations aimed at the increasing of effectiveness of functioning the system of national security of Ukraine.

At present the author has already done the following in the scientific sphere:

For the first time:

  • the essence of national security as an object of law science where national security is viewed as a regulated by the administrative law activity of the subjects to ensure national security has been determined;
  • scientifically grounded and determined the criteria of the formation of national security spheres which are represented by the integral indicators of the synthesis of national interests, real and potential threats;
  • the administrative and legal regularities as for the formation of national security system have been revealed, the main being: 1) derivative character of administrative legal relations from the formation of certain spheres of national security;  2) interdependence of the objects of administrative legal relationships with the objects of national security; 3) interdependence of the subjects of administrative legal relationships with the subjects ensuring national security; 4) the presence of vertical and horizontal relations between the subjects of administrative relationship in the sphere of national; 5) independent development of the system ensuring national security within the framework of administrative legal relations in contrast to administrative managerial ones;
  • the basics of general theory of national security with the interdisciplinary approach have been formulated;
  • a new typology of approaches to the determining of notions “security”, “national security”, “national interests”, “threat”, “ensuring national security”;
  • the suggestions as for further improvement of legislation on national security have been made, especially the author’s drafts of law bills of Laws of Ukraine “On the Doctrine of Non-State Ensuring National Security of Ukraine”, “On Non-State Ensuring National Security of Ukraine”, “On Security Service of the Subjects of  Business”, “On Criminal Secret Service”;

further developed:

  • the investigation of approaches to singling out the subjective, physical and functional spheres of administrative and legal regulation of national security as a complementary condition as for the reference of national security to the object of administrative and legal science;
  • theoretical problems of formation and functioning of the system of state administration bodies in the sphere of national security of Ukraine, as well as clear-cut definition of their administrative and legal status;
  • the criteria of systematization of measures of administrative and legal enforcement in the context of their determination with the stages of development of threats for national security;
  • theoretical argumentation of the necessity to develop the Conception of national security in Ukraine, doctrines of national security, Law of Ukraine “On National Security of Ukraine” and other normative and legal acts.

improved:

  • approaches to the correlation and classification of the factors that generate danger: “threat”, “danger”, “challenge”, “risk”, “factor”. The standpoint was grounded according to which threats have several stages of development, so some researchers refer them to as “challenge”, “risk”, “factor”. The conclusion was made as for expediency of singling out two types of factors: threat and danger;
  • the conceptual foundations of ensuring national security as for the main tasks, trends, subjects, objects, principles and means of such activity in Law of Ukraine “On the Foundations of National Security of Ukraine” were determined;
  • proved the necessity to introduce into scientific circulation the notions of “subsystem of state ensuring national security” and “subsystem of non-state ensuring national security” and their definitions were given.

The results of the scientific research are widely implemented in law making, law applicable and scholar activity and educational process which is proved by 13 implementation acts, namely:

1) taking part as an expert of National Academy of Internal affairs of Ukraine in the work team while developing the draft Law of Ukraine “On Struggle Against Terrorism” and making some suggestions which were taken into account;

2) while preparing and lecturing the author’s course “Security Studies” at the Institute of Business Security of European University; while preparing working plan in this discipline and publishing a textbook of the same title which was recommended by Ministry of Education and Science of Ukraine for those majoring in the sphere of security;

3) in the teaching process in National Academy of Internal Affairs of Ukraine, course “National Security of Ukraine”;

4) while preparing half-courses in National Academy of Security Service of Ukraine: “Organization of Counter-Intelligence Activity of Security Service of Ukraine”, “Intelligence Activity of Special Services of Foreign States”, “Activity of Security Service Bodies of Ukraine in Emergency Situations and under Conditions of Emergency and War”;

5) while delivering the course “Business Security” at Kyiv International University;

6) while organizing of operative and search activities in cases associated with the protection of the interests of a person and society at Main Board in Organized Crime Combat of ministry of Internal affairs of Ukraine;

7) while preparing the analytical data on theoretical and legal aspects of overseas experience in fighting with terrorism and appropriate proposals as for the improvement of the Ukrainian legislation in effect concerning fighting with  terrorism;

8 ) while preparing the analytical data on theoretical and legal aspects of overseas experience in developing the conception of national security of the country and relevant recommendations as for the formation of a new Conception of national security of Ukraine;

9) while preparing materials for parliamentary hearing on the topic: “Foreign Policy as an Instrument of Ensuring National Interests: Realities, Achievements, Prospects”;

10) while teaching students of Session 41 at International Law Enforcing Academy in Budapest, Hungary on the issues of ensuring national security and fighting with terrorism;

11) while using the materials during peace-making operations in Kosovo;

12) while delivering lectures for senior police officers in Germany;

13) while preparing bills “On the Struggle Against Extremism”, “On Criminal Secret Service” (officially registered at Verhovna Rada (Parliament) of Ukraine (No.9264 of March 30, 2006), “On Business Security Services” (officially registered at Verhovna Rada (Parliament) of Ukraine (No. 9187 of March 2, 2006).

The practical significance of the results obtained by the author lies in the fact that they may be applied in the following spheres:

Law making — while improving the legislature on national security

Law applicable activity — as a methodological basis for further research of the problems of administrative and legal regulation of national security; while educating people on security, increasing its level state officials; improvement of administrative measures to ensure national security;

Educational process— while teaching courses in administrative law, national security of Ukraine, general theory of national security, management theory of social system security, sociology, criminal law, theory of state administration;

In research — in the process of scientific and research work of students, cadets, preparing lecture courses, textbooks, manuals, further development of foundations of national security.

At present the following problems are in the focus of the author’s academic attention:

  • the essence of national security as an object of cognition;
  • the essence and the structure of social relations in the sphere of national security;
  • the status and trends of improvement of the system national security administration;
  • the competence of the subjects ensuring national security, revealing their functions, disclosing their content;
  • the regularities of the formation of the security systems of different levels under globalization conditions;
  • the basics of the formation of general theory of national security as an independent interdisciplinary scientific trend, its object of study and research being national security, its content, structure, levels, its place among other sciences, methodology, subject-matter, object etc.;
  • methodology of simulation the national security administration system;
  • the status of legal regulation of national and international security;
  • the ways of increasing effectiveness of ensuring national and international security under conditions of globalization;
  • the mechanisms of adaptation of international and national legislature in the sphere of ensuring national security.
